Welcome to Living Healthy Body and Mind. These Terms of Service (“Terms”) govern your access to and use of our website, telehealth services, and any other services we provide (“Services”). By using our Services, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue using our Services immediately.

2. Changes to Terms

Living Healthy Body and Mind reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

3. Eligibility

Our Services are intended for users who are at least 18 years old. By using our Services, you represent and warrant that you are at least 18 years of age. If you are under 18, you may use our Services only with the involvement of a parent or guardian.

4. Use of Services

  • Telehealth Services: Our telehealth services allow you to consult with healthcare providers remotely. These services are subject to your compliance with all applicable laws and regulations.
  • User Accounts: You may be required to create an account to use certain Services. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.
  • Prohibited Conduct: You agree not to use the Services for any unlawful purpose or in any way that could harm or impair the operation of the Services. This includes, but is not limited to, the transmission of any harmful or malicious code.


5. Medical Disclaimer

Living Healthy Body and Mind provides telehealth services that allow you to consult with licensed healthcare providers. However, the Services do not replace your primary healthcare provider or emergency services. In the event of a medical emergency, you should call 911 or go to the nearest emergency room.

6. Payment and Fees

  • Payment Terms: Payment for Services is due at the time of scheduling unless otherwise specified. We accept credit cards, HSA cards, and offer financing options through Advance Care.
  • Refunds: All payments for Services are non-refundable unless otherwise stated in a specific Service agreement.


7. Appointment Policy.

  • Late and No-Show Policy: If you are more than 10 minutes late for a telehealth appointment, your visit may be canceled, and you may be subject to a no-show fee. After two no-shows, you may be discharged from the practice.
  • Cancellation: Appointments must be canceled or rescheduled at least 24 hours in advance to avoid a cancellation fee.


8.Prescription Policy

  • Medication Refills: Medication refill requests must be made at least 48 hours in advance and can be requested through our website. We do not replace lost, stolen, or expired prescriptions for controlled substances.
  • Controlled Substances: Prescriptions for controlled substances are subject to additional monitoring and regulations, including a requirement for regular follow-up visits. Violation of our controlled substance policy may result in termination of the provider-patient relationship.

9. Privacy and Security

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you agree to the terms of our Privacy Policy.

10. Termination

Living Healthy Body and Mind reserves the right to terminate or suspend your access to the Services at any time, with or without cause, and with or without notice.

11. Limitation of Liability

To the fullest extent permitted by law, Living Healthy Body and Mind and its affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which our principal office is located, without regard to its conflict of law principles.

13. Dispute Resolution

Any disputes arising out of or related to these Terms or the Services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
